Terms and Conditions for Rubbish Removal Waste Services
These Terms and Conditions set out the basis on which our rubbish removal waste services are provided to residential and commercial customers in the UK. By making a booking, requesting a quotation, or allowing our team to attend a site, you agree to be bound by these terms. They are intended to create a clear, fair, and lawful framework for the collection, handling, transportation, and disposal of waste. Where we refer to waste removal services, rubbish clearance, or junk removal, these expressions all describe the same service unless stated otherwise.
These terms apply to all bookings, whether arranged by telephone, email, online form, or other accepted method. They should be read together with any written quotation, job confirmation, or service specification provided to you. If there is any conflict between these terms and a specific written agreement, the written agreement will take priority only to the extent of that inconsistency. Nothing in these terms affects your statutory rights as a consumer where such rights apply.
We reserve the right to update these terms from time to time. The version in force at the time of your booking will usually apply to that booking unless a newer version is expressly agreed. It is your responsibility to review the terms before confirming a service, particularly where the booking involves mixed waste, heavy items, restricted materials, or access conditions that may affect the collection.
1. Booking Process
A booking for waste removal is formed once we have accepted your request and issued a confirmation. Before acceptance, any quotation or estimate is provided as an invitation to proceed rather than a binding offer unless we clearly state otherwise. To help us provide an accurate service, you must give truthful and complete information about the volume, type, location, and accessibility of the waste to be collected.
When requesting a quote for rubbish removal waste, you may be asked to provide photographs, item descriptions, estimated weight, and any special handling requirements. If the waste differs materially from the information supplied, we may revise the price, amend the service scope, or decline to carry out the collection. Examples include concealed items, excessive quantities, hazardous materials, or conditions that make safe removal impractical.
We may offer a time slot, arrival window, or scheduled date for the collection. While we always aim to attend on time, all times are estimates unless a fixed appointment has been expressly confirmed. Access delays, traffic, weather, prior jobs, or operational issues may affect arrival times. You must ensure that an authorised person is present at the property or site to approve the work, unless we agree otherwise in advance.
Customer obligations at the time of booking
By confirming a booking, you warrant that:
- you are entitled to arrange the removal of the waste from the premises;
- the waste presented for collection is accurately described;
- you have disclosed any items requiring special handling;
- safe access will be available for our team and vehicle; and
- you will ensure that any permission, permit, or consent needed for access has been obtained.
If you are booking on behalf of another person, organisation, landlord, or business, you confirm that you have authority to do so. We may rely on your instructions as binding. We are not responsible for disputes between occupiers, owners, tenants, or managing agents regarding the authority to authorise collection unless we have been expressly notified of any limitation in writing before the service is carried out.
We may refuse or cancel any booking where we reasonably believe the waste presents a risk to health, safety, legal compliance, or operational feasibility. This includes situations where the site is unsafe, the waste is contaminated, the customer has withheld relevant information, or the request falls outside the scope of our permitted services. In such cases, any charges already incurred may remain payable.
2. Payments and Charges
Our charges are generally based on the volume, weight, type of waste, labour required, loading time, access conditions, and disposal costs. Prices may also reflect separate handling requirements for items such as mattresses, appliances, builders’ waste, commercial rubbish, or bulky household items. Any estimate provided before attendance is based on the information you supply and may change if the actual waste differs.
Unless stated otherwise, payment is due on completion of the service on the day of collection. We may require a deposit, full advance payment, or part payment before attendance for certain services or commercial accounts. We accept payment methods that are confirmed during booking, and we may decline to proceed if payment cannot be authorised when due. Title to any collected goods or waste passes to us only where lawful and only once payment obligations have been satisfied.
You are responsible for paying any agreed charges even if you later decide that some items should not have been removed, provided the removal has already been completed according to your instructions. If you request additional items to be taken on the day, we may amend the price accordingly. Any quotation is exclusive of unforeseen charges arising from inaccurate descriptions, inaccessible waste, waiting time beyond reasonable limits, or the presence of prohibited materials.
Where payment is late or refused, we may suspend further services, charge reasonable recovery costs, and retain any goods lawfully in our possession to the extent permitted by law. Interest on overdue sums may be applied at the statutory rate where lawful and appropriate. We may also require satisfactory payment history before accepting future bookings.
Refunds and pricing adjustments
Refunds are considered only where we have materially failed to deliver the agreed service and where you have paid amounts not properly due. If the service is partially completed due to site conditions, restricted access, or your instructions, any refund will be limited to the unused portion of the service, if any. Assessment of charges and any adjustment will be made in a reasonable manner based on the circumstances.
3. Cancellations, Delays, and Rescheduling
You may cancel or reschedule a booking, but we ask that you provide as much notice as possible. If cancellation occurs after preparation has begun, or if our vehicle and team have already been dispatched, we may charge a cancellation fee to cover administrative and operational costs. The amount of any fee will be reasonable and proportionate to the work already undertaken.
If you are not present at the agreed time, if access is denied, or if the waste is not ready for collection, we may treat the booking as cancelled by you and charge a call-out or failed-attendance fee. We may also offer a revised appointment subject to our availability. For time-sensitive rubbish removal waste jobs, you should ensure the site is prepared before the agreed arrival window.
We may need to reschedule a booking due to weather, vehicle breakdown, staff illness, legal restrictions, disposal site closures, or other events outside our reasonable control. Where this happens, we will use reasonable efforts to arrange a new time. We are not liable for minor delays where we have acted reasonably and communicated the issue in a timely manner.
Nothing in this section limits your rights in relation to services that are not supplied with reasonable care and skill. However, you acknowledge that waste collections can be affected by factors outside our direct control, including third-party access rules, unexpected site restrictions, and safety concerns identified on arrival.
4. Liability and Service Limitations
We will provide our waste removal services with reasonable care and skill. If we damage property through our negligence, we will consider liability in accordance with applicable law. However, we are not responsible for pre-existing defects, unsecured items, hidden services, fragile structures, or damage caused because you failed to disclose relevant information or ensure safe access.
You must remove or protect items you do not want taken or disturbed. Unless we agree in writing, we are entitled to rely on the descriptions you provide and the items presented for collection. We are not liable for accidental removal of items that were left with waste, placed in a collection area, or not clearly separated from the material to be taken away.
To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential losses, including loss of profit, loss of opportunity, business interruption, or inconvenience. Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot be excluded under UK law.
Property access and handling
You agree to give us reasonable access to the premises and to inform us of any hazards, parking limitations, restricted entry, narrow stairways, contaminated areas, or structural concerns. If our team reasonably believes that a job is unsafe, we may pause or stop the service. We are not responsible for any loss arising from a refusal to continue where doing so would expose our staff or others to risk.
Where lifting, moving, or dismantling is required, you accept that there may be minor scuffs or marks associated with the normal performance of the service, provided we have taken reasonable care. If you request that items be removed from within a property, we may decline to move items that are too heavy, unstable, or hazardous for safe handling. Our team may make practical decisions on site to complete the work safely and lawfully.
We do not accept responsibility for items not included in the agreed service scope. If you require disposal of special, regulated, or high-risk items, you must tell us before booking so that we can confirm whether the service is permitted. If we discover such items on site without prior disclosure, we may refuse collection or charge additional fees where lawful and appropriate.
5. Waste Regulations and Environmental Compliance
All waste collected under these terms must be presented lawfully and truthfully described. You must not conceal prohibited, hazardous, or contaminated waste within general rubbish. We operate in accordance with applicable UK waste law, including obligations relating to carrier authorisation, transfer documentation where required, duty of care, and lawful disposal at approved facilities. By using our rubbish removal waste service, you agree to cooperate with those requirements.
You are responsible for informing us of any waste that may be classified as hazardous or subject to special controls, including but not limited to asbestos, chemicals, solvents, clinical waste, pressurised containers, fuel, oils, paints, batteries, fluorescent tubes, or electrical items with specific handling rules. Such materials may require separate arrangements and may be excluded from standard junk removal services. We may refuse any item we reasonably believe is unsafe, unlawful to transport, or unsuitable for our current service.
Where legal, we may separate, sort, load, and transport waste for recycling, recovery, or disposal in line with environmental obligations and operational practice. You acknowledge that once waste has been collected, it may be transferred, processed, recycled, or disposed of at facilities we consider appropriate and lawful. Unless otherwise agreed, ownership and responsibility for waste pass to us only to the extent allowed by law and only for the purposes of lawful handling and disposal.
You agree not to present stolen, unlawfully held, or dangerous items for collection. If we suspect illegal activity or a breach of waste regulations, we may refuse the service, notify relevant authorities where required, and retain records as necessary for compliance. Any customer information supplied in relation to waste may be used for verification, audit, legal, and operational purposes in accordance with applicable data and compliance obligations.
6. Customer Responsibilities
You must ensure that the waste is ready for collection at the agreed time and that all relevant items are accessible. You are also responsible for separating items not intended for removal. If you fail to do so, we may remove all items reasonably appearing to form part of the instructed collection. Please take special care where the site contains valuables, confidential documents, medicines, or personal effects.
You must notify us in advance of any known risks, including infestation, contamination, structural instability, sharp objects, or restricted entry. Failure to disclose such issues may affect pricing, timing, or our ability to complete the job safely. We may suspend or terminate a service if your conduct, the site conditions, or the materials presented create an unacceptable risk.
You also confirm that any waste placed for collection has been generated or held lawfully and that you have the right to instruct its removal. Where a third party challenges the collection, you agree to cooperate with reasonable verification steps. Our obligation is limited to providing the agreed service in a lawful and professional manner on the basis of the information supplied.
7. Governing Law and Disputes
These Terms and Conditions, and any dispute or claim arising out of or in connection with them, are governed by the law of England and Wales unless we agree otherwise in writing. If you are based elsewhere in the UK, mandatory local consumer protections may still apply where relevant, but the governing law for the contract will remain as stated unless prohibited by law.
If a dispute arises, both parties should first try to resolve it in good faith and within a reasonable time. Where a matter cannot be resolved informally, the parties may pursue their rights through the courts with appropriate jurisdiction. If any provision of these terms is found unenforceable, the remaining provisions will continue in full force to the extent permitted by law.
These Terms and Conditions are designed to ensure that our waste clearance, rubbish removal, and rubbish removal waste operations remain safe, compliant, and transparent.
